This training session will focus on challenges to arbitrators in international commercial arbitration for lack of impartiality and/or independence. It will discuss what is meant by impartiality and independence, explain how challenges are made procedurally, and consider the relevance of the IBA Guidelines on Conflicts of Interest in International Arbitration. By the end of the session, participants will have an understanding of the merits and demerits of making arbitrator challenge applications, how and when such applications are made in international arbitration proceedings, and the practical considerations when making or responding to them.
